SMS Terms & Conditions 

 

Providing your mobile phone number constitutes your express consent to receive recurring automated and non-automated SMS/MMS messages from reStart, Inc. Consent is voluntary and is not a condition of receiving services, employment consideration, or making a donation. You consent to receive SMS messages from reStart, Inc. related to events, promotions, organizational news, donation solicitation, and staff notifications (for participants requesting case management assistance only).  

Individuals under 18 years of age should obtain consent from a parent or legal guardian before enrolling where required by law. 

By enrolling, you represent that you are the authorized subscriber or customary user of the mobile number provided. Wireless carriers are not liable for delayed or undelivered messages. This messaging program is intended for recipients within the United States. 

SMS communications are not monitored continuously and should not be used to report emergencies. If you are experiencing an emergency, call 911 immediately. These Terms and Conditions shall be governed by laws of the state of Missouri, without regard to conflict of law principles.  

To the fullest extent permitted by law, reStart shall not be liable for delayed, failed, or misdirected SMS/MMS transmissions or any indirect damages arising from participation in the messaging program. 

Message frequency varies depending upon your relationship with reStart and communication categories you select. reStart retains records of SMS consent in accordance with applicable laws and organizational record retention policies. 

Message frequency may vary. Standard message and data rates apply in conjunction with your mobile carrier.  

reStart, Inc. will not engage in sending illegal, misleading, or deceptive content. This can include but is not limited to content related to hate speech, fraud, or illicit goods. 

reStart reserves the right to modify these SMS Terms and Conditions at any time. Updated terms will become effective upon posting to our website. Continued participation in the messaging program following any changes constitutes acceptance of the revised terms. 

HIPAA Confidentiality Disclaimer 

SMS/MMS messages are not intended for the transmission of sensitive personal, medical, behavioral health or other confidential information. Please contact reStart directly if you need to discuss confidential matters. 

Opting Out 

You may opt out of receiving SMS messages at any time by replying with “STOP” to any SMS/MMS message you receive from reStart, Inc. After opting out, you will receive a confirmation message, and we will cease sending SMS/MMS messages to your number. 

Except as required by law or as necessary to operate our messaging services through contracted service providers acting on our behalf, reStart does not sell, rent trade, or share mobile numbers or SMS consent with third parties for their independent marketing purposes 

Re-enrolling in reStart’s Communication Program 

You may, at your discretion, re-enroll in reStart’s Communication Program after opting out. Your re-enrollment constitutes your express consent to be bound by all of the terms and conditions of this Agreement, as amended from time to time. 

To re-enroll, you must log in to your account and complete the re-enrollment process as instructed. By proceeding, you acknowledge that you have read, understood, and agreed to the terms governing reStart’s Communication Program. You understand that your re-enrollment is voluntary and that you are under no obligation to re-join. Upon successful re-enrollment, the terms of this Agreement will apply to your participation going forward.

Privacy Policy 

Your phone number will be handled in accordance with our Privacy Policy, available at: HERE 

No mobile phone information will be shared with third parties/affiliates for marketing purposes/promotion purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We implement reasonable administrative, technical and physical safeguards designed to protect personal information from unauthorized access, disclosure or misuse.
